How does Awaab’s Law effect Landlords?

New legislation forcing landlords to tackle damp and mould issues within strict timescales is being introduced. Aimed at social housing landlords, the new obligations on both landlords and tenants aims to help and improve living conditions. 

Known as Awaabs Law, the amendment is a new requirement that has been included in the Social Housing (Regulations) Act. It is in memory of Awaab Ishak, aged two, who died after being exposed to mould at his Rochdale home in December 2020 .

 

 

 
 
 

WHAT DOES AWAAB’s LAW MEAN FOR LANDLORDS?

Social landlords will have to investigate damp and mould hazards within 14 days of a report, start repairs within a further seven days, and make emergency repairs within 24 hours if necessary.

The regulation could be applied to private tenanted properties because a rental property should be safe and in a good state of repair as required under the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018.

Therefore, Landlords must react promptly to reported damp and mould issues, identifying underlying causes and implementing solutions.

It is recommended that landlords should take steps to actively prevent damp and mould through regular inspections and upkeep.

 

HOW DOES AWAAB’s LAW AFFECT TENANTS?

Tenants are obligated to notify landlords about any damp and mould concerns, providing detailed information for effective resolution.

This will involve granting access for inspections and repairs and adhering to advice to prevent or mitigate incidents.

Tenants can take legal action if landlords fail to comply within specified timelines.

WHAT ACTION SHOULD BE TAKEN BY A LANDLORD?

If landlords are faced with outbreaks of mould, HPC can survey properties and identify potential hazards and damage.
